THE COURT CONFIRMS THE BELOW INFO, THE TRIAL WILL BEGIN WITH JURY SELECTION JANUARY 5TH, 2010.....IF THEY CAN NOT FIND A PARTIAL JURY, THE JUDGE MAY CONCIDER MOVING THE TRIAL TO A NEW VENUE AT THAT TIME.
FROM THE CANTON REP.
CANTON - The aggravated murder trial of James Mammone III will stay in Stark County.
Common Pleas Judge John G. Haas denied a request Thursday by Mammone's attorneys to move the trial, scheduled for January, to a different county. However the judge said the defense can revisit the issue as the case gets closer to trial.
Mammone, 35, of Canton, is charged with three counts of aggravated murder and other crimes for the June 8 deaths of his two children, James IV and Macy, and his former mother-in-law, Margaret Eakin.
He has pleaded not guilty. If convicted, Mammone could be sentenced to die.
