CLEVELAND, OH (WOIO) - The man accused in a two-year-old Cleveland boy's death was indicted on charges of aggravated murder and murder Wednesday.

Deandre Heiskell was watching his girlfriend's three children - ages 8 months, 2, and 5 - at their eastside residence while she was at work.

Prosecutors allege Heiskell got angry with 2-year-old Carlito Teer when he soiled his diaper. He is accused of striking the small child in the stomach with his fist.

EMS was called and when they arrived the victim was cold, having no pulse. EMS transported the victim to Rainbow Babies & Children's Hospital and was pronounced dead on arrival.

Carlito suffered a laceration of the liver; blood in his abdominal cavity; multiple blunt force trauma to the head, neck and torso including numerous bruises to the chest, back, and side; and bruising on the side of both jaws.

Heiskell says the boy was choking and he was simply trying to help.

He faces the death penalty if convicted.
