Elyria mayoral candidate Timothy Quinn challenges removal from the ballot

ELYRIA, OH (WOIO) -

An Elyria mayoral candidate filed a lawsuit in the Ohio Supreme Court requesting that the Court grant his Writ of Mandamus, compelling the Lorain County Board of Elections to place him back on the ballot for the November 8, 2011 General Election.

Timothy Quinn claims that his disqualification on May 24,2011 based upon Advisory Opinion 2007-05 issued by the fonner Secretary of State of Ohio Jennifer Brunner is illegal and unlawful and unconstitutional.

Quinn claims that the Advisory Opinion 2007-05 is unconstitutional on its face and as applied to him. 

His attorney, Gerald W. Phillips, says it discriminates against independent candidates in favor of the two party system, meaning Democrats and Republicans.

Quinn has previously run as an independent candidate and has never run as a Democrat or Republican.
