Family of teen accused in deadly hit & run now subject of a lawsuit

A lawsuit has been filed against a teenage high school girl and her parents for the death of an elderly woman in a hit and run crash last year. The suit even names the company that owned a 2010 GMC Acadia leased to the family and driven by the girl.

81 year old Maxine Lobins died crossing Lorain Avenue in Cleveland. Weeks later, Cleveland Police Accident Investigators identified the suspect, a 16 year old girl, living and going to school in the area.

The criminal charges are still pending in juvenile court.

Now, a lawyer for the family has filed a civil suit in Cuyahoga County Court. We'd been told previously, the teen girl deals with mental and physical handicaps, and the suit calls her an "incompetent driver." It also says her parents "negligently" allowed her to get a driver's license despite knowing she "posed a hazard to the public."

Attorney R. Jack Clapp says the Lobins family suffered a "tremendous loss." While  the suit does seek financial damages, Clapp says it is also about accountability. He told 19 Action News, "The Lobins family hopes to hold people accountable, so the same thing doesn't happen to another family."

The suit was just filed Tuesday afternoon, and it was assigned to Judge Robert McClelland.
