Fremont mother suing sheriff for death of son

Bryan Jones Bryan Jones
SANDUSKY COUNTY, OH (Toledo News Now) -

The mother of a Fremont man can continue with her lawsuit against Sandusky County authorities, who she says shot and killed her son.

"This isn't so much a case needing to argue what it is occurred so much as it is simply to display to the jury what the undisputed facts are," said Dennis Murray, Sr., Kim Jones' attorney.

Jones sued Sandusky County Sheriff Kyle Overmeyer and two deputies following the shooting death of her son Bryan.

On the night of Bryan's death, Jones and her husband had called the sheriff's office to report that Bryan had been drinking and had a gun. According to the lawsuit, when deputies arrived, they saw Bryan sleeping on the couch with his shotgun, "with no prospect of him being able to injure anybody else, including the police officers, as long as they don't barge into his home," Murray said.

The excessive force lawsuit claims the deputies used a flash-bang grenade, but Murray says they had other options.

"Common alternatives like a bullhorn, like bright lights, the techniques that we're all used to understanding," he said.

The lawsuit also claims that within seconds, deputies had shot Bryan so many times that one of his arms was severed.

The deputies say Bryan pointed the shotgun at them and they were defending themselves.

Kim Jones is suing for $20 million. There is no timeline as to how long it will take to get a trial going.
