LAKE COUNTY, OH (WOIO) -

For the second time during his four year sentence, the drunk driver responsible for the crash that killed Willoughby Police Officer Jason Gresko in September of 2012 has filed for early release from prison.

Scott Leland pleaded guilty to aggravated vehicular homicide and OVI in July 2013 and was sentenced to four years in prison.

Officer Gresko was killed in the line of duty on September 21, 2012 when his cruiser collided with Leland's pick-up truck while he was responding to an emergency call. Leland had a BAC of .14.

Leland has served one year of his sentence. He first applied for early release back in March but was denied.

A petition has been started by supporters of the Gresko family to urge Judge Gibson to retain Leland's sentence.
