Local attorney charged with taking drugs into jail

We're tracking new developments in an investigation into an attorney taking drugs into a county jail, now dragging on for nearly three months. If you take drugs into a county jail good chance you won't go home. But local attorney Russell Bensing just got hit with a minor charge for something that happened in September.

Investigators say they caught a local lawyer with a small amount of drugs at the Cuyahoga County Jail. We found the lawyer got released that morning with no charges.   

Russell Bensing was finally hit with a minor charge. Drug abuse, with less than 100 grams of marijuana. City and county prosecutors couldn't agree which office should handle it, leading to the delay.

The county prosecutor's office didn't think the lawyer wanted to give the drugs to an inmate, so no felony.  

Meanwhile, an internal investigation is also going on with this case involving possible punishment for jailers letting Bensing go that day. That is still not finished.

Bensing earlier told 19 Action News reporter Ed Gallek no comment. Records show he's been accepted into a first offenders program and could have his record wiped clean. Maybe next March. Nothing with this case is happening quickly.
