PARMA, OH (WOIO) - The pictures of 11-year-old Devon Smith in the emergency room on Feb. 11 show scrapes, cuts and swollen eyes, after a snowball fight with friends leaving Shiloh Middle School in Parma.
Police say Ramon Valle caused those injuries after his daughter was hit with a snowball.
"He told them don't, kind of cussing at the boys, don't throw no f-ing snowballs at my daughter," said Richard Smith, Devon's father.
"My son asked him 'why are you up in our face you're a grown man what are you going to do to us?' He spit in his face at first and after he spit, my son pushed him and he jumped on him and started beating him," said Smith.
According to court records, Valle pleaded guilty to beating up Smith. That on the surface could get him a year in jail when he is sentenced next month.
"Show him no mercy. There's no justification for beating up an 11-year-old son, 11-year-old kid. You're a 35-year-old grown man. You should be able to handle situations better than that," said Smith.
This is the second time in a year that Valle has assaulted a child over a snowball fight. Almost the exact same incident happened in March 2014 with a 13-year-old boy. Valle was convicted of assault in that case.
Valle's sentencing is this case is set for April 8.
