Man shot and killed by police no stranger to law, criminal history dates back to 70s

Cleveland Police are investigating an officer-involved shooting on the city's east side. It happened at 11:45 p.m. Tuesday on Ottawa Road.

Police say a woman walked into the Fourth District Police Station around 11:30 p.m. and reported that her husband was at their home on Ottawa, threatening her and their downstairs neighbor.

The woman told police the man was armed.

When officers arrived at the house on Ottawa, they made their way upstairs and encountered 64-year-old Theodore Johnson.

Police say Johnson fired two rounds from a .45 caliber handgun at the officers, hitting Officer David Muniz in the chest. Muniz was wearing a bulletproof vest.

"He was hit right in the heart. There's an extra shock plate in there and that's where he was hit. He was hit square in the vest," said Steve Loomis, president of the Cleveland Police Patrolmen's Association.

The officers retreated back down the stairs, and say Johnson followed with the gun in his hand yelling at officers to shoot him.

Investigators say Johnson refused to drop the weapon and began to raise it again. Four officers fired a total of five rounds at Johnson, who was pronounced dead at the scene.

Officer Muniz was taken to MetroHealth Medical Center, where he was treated and released.

The incident took place in Cleveland's Fourth District, where police officers started using body cameras last month. Police Chief Calvin Williams says there is video of the shooting.

The officers involved will be placed on a three-day administrative leave, which is protocol, while the investigation continues.

Muniz' partner, John Lyons, survived a shooting back in October. His bulletproof vest also saved him when a suspect opened fire on Ottawa Road just a few houses away from where Tuesday's shooting took place. Lyons had just returned to work two days ago.

According to court records, Theodore Johnson has a lengthy criminal past. He was indicted in 1976 for aggravated murder but was eventually found not guilty by a jury. He has a host of other charges dating back to 1972, including armed robbery, aggravated robbery, theft and assault. 

In 1992, Johnson was convicted of carrying a concealed weapon and sent to prison for two years.

    Medical Mutual of Ohio has confirmed that an employee sent 45 emails to the wrong person containing personal information for more than 6,000 of its Medicare Advantage customers.  According to a spokesperson for Med Mutual, based in Cleveland, this was an accident because the employee typed in an incorrect email address and the data was going to a third party that didn't have authorization to be looking at private information.
