Man Who Gunned Down Ex-Wife Set For Execution

LUCASVILLE, Ohio (AP) - A man who gunned down his ex-wife 13 years ago was set for execution Tuesday after losing a last-minute request to delay his death sentence to allow him to challenge the state's lethal injection method.

The execution of James Filiaggi, 41, would go forward and witnesses were being taken to the death chamber around 10:45 a.m. after the U.S. Supreme Court ruling, state prisons spokeswoman Andrea Dean said.

All litigation in the case was complete, she said.
