Judge Declares Mistrial in Death Penalty Case

Cleveland, OH - New developments on a death penalty trial in Cleveland.

A judge has declared a mistrial for Fernando Newcomb - right in the midst of closing arguments.

Newcomb is accused of killing Alvin McKnight - then burning his body.

But during closing arguments - the prosecutor made improper comments about Newcomb not testifying.

The judge threw the case out and must decide if prosecutors can proceed with a new trial.
