New video released from road rage incident with U.S. Rep. Max Miller and Avon doctor

ROCKY RIVER, Ohio (WOIO) - The city of Rocky River’s law department released new video from a June road rage incident that involved an Avon doctor and Ohio Congressman Max Miller.

According to police, Miller called 911 around 9:30 a.m. on June 19, saying while he was driving to work, a man layed on his horn and ran him off the road when he couldn’t get his attention, while trying to show the Palestinian flag.

The new cell phone video shows Dr. Feras Hamdan recording Miller while making a homophobic slur and calling him a racist.

Miller also said Hamdan yelled death to Israel and threatened to kill him and his family during the incident.

He was charged with aggravated menacing and ethnic intimidation, and pleaded not guilty to both in Rocky River Municipal Court.

Hamdan received a $500,000 bond at his June 20. arraignment.

The case was bound over to a Cuyahoga County Grand Jury.

Cuyahoga County Prosecutor Michael O’Malley announced on July 8 that the grand jury returned an indictment charging Feras Hamdan with:

  • One count of ethnic intimidation (F5)
  • One count of tampering with evidence (F3)
  • One count of aggravated menacing (M1)
  • One count of menacing (M4)

Hamdan will be arraigned at the Cuyahoga County Justice Center on July 25 at 830 A.M.

Hamdan’s attorney, Issa Elkhatib released the following statement about the new video:

The video currently circulating online is complete and unedited — what the public has seen is the entirety of the footage. That matters because Congressman Max Miller’s narrative is not supported by anything beyond his own accusations, and the full context of the video reveals no threats, no criminal conduct, and no evidence to support the charges being promoted in the media.

The language used by Dr. Hamdan in the video — including an angry and inappropriate epithet — was the product of a moment of political frustration. It was not part of any threat, nor was it motivated by hatred of any kind. Dr. Hamdan’s anger stems from deep disagreement with Congressman Miller’s public positions, particularly his inflammatory statements regarding Palestinian civilians and foreign policy issues that Dr. Hamdan, like many others, finds deeply offensive.

We are not here to defend every word spoken in that moment — Dr. Hamdan is human and expressed himself harshly in a charged exchange. But what he did not do is threaten, intimidate, or attempt to harm anyone. That distinction matters. Political disagreement — even when passionately expressed — is not a crime, and conflating it with violence is both dishonest and dangerous.

More importantly, the available evidence does not support Congressman Miller’s version of events. In fact, his claims are directly contradicted by objective data, including surveillance footage and inconsistencies in his own statements. It is Dr. Hamdan — not Congressman Miller — who subpoenaed ODOT traffic cameras, requested GPS and Tesla vehicle data, and took legal steps to preserve every piece of relevant evidence. That is not the behavior of someone trying to conceal wrongdoing — it is the behavior of someone pursuing the truth.

This case is quickly revealing itself to be a politically motivated effort to silence dissent and smear a private citizen. Dr. Hamdan is a physician, husband, father, and respected community member. He has no criminal history and has never demonstrated any form of hatred or violence.

We are confident that as this process unfolds, the facts will clear Dr. Hamdan’s name and expose this case for what it is — a manufactured controversy built on distortion, not truth.
