CLEVELAND, Ohio (WOIO) - Attorneys representing Gregory Moore filed a Motion to Dismiss his case Wednesday in Cuyahoga County Court of Common Pleas.

Moore is facing charges related to the 2013 murder of Aliza Sherman.

The defense is calling for the case to be dismissed for two main reasons. First, they claim the document used to charge Moore isn’t a legal indictment. Instead of saying “A True Bill” (which means a Grand Jury officially approved the charges), the document says “Draft Indictment” on every single page. The defense argues this means the State never actually got the legal authority to move forward with the trial.

Second, the defense accuses the State of “outrageous government misconduct.” They claim the prosecution gave the Grand Jury false and misleading information about cell phone records, DNA evidence, and missing video footage to make Moore look guilty. They even suggest that another person, Sanford Sherman, was a more likely suspect but was ignored by investigators.
