AKRON, Ohio - An Akron-area man who has served 10 years in prison for the death of his infant son is due for release because a judge says the case was ambiguous.

Boyd Lee Blankenship, 45, of Coventry Township, has always maintained his innocence in the 1991 death of his 6-month-old son Mark. The baby died of internal injuries.

A judge in Akron approved his release from prison on Monday. Judge Jane Bond described the evidence in the case as ambiguous and says questions were left unanswered.

The baby's mother also was convicted, but that was overturned on appeal after she served one year in prison. The parents claimed the baby was injured by a child restraint during a sudden stop in traffic.
