Grand jury indicts driver accused of killing 3-year-old eating at Beachwood restaurant

CLEVELAND, Ohio (WOIO) - A Cuyahoga County Grand Jury indicted the driver accused of killing a three-year-old girl who died after being struck by a car while while eating outside with family members at a Beachwood restaurant.

The accident happened around 1:30 p.m. June 21 at City Barbeque at the Pavilion Shopping Center.

Jasmine McFadden, 18, of Euclid, was indicted on the charges of aggravated vehicular homicide and negligent assault. She will be arraigned on Aug. 12.

Beachwood police said McFadden was driving through the parking lot of the shopping center, when she left the road, crossed a curb, and entered the outdoor dining area of City Barbeque.

The vehicle then crashed into the little girl.

After the accident, the child was rushed to Cleveland Clinic-Hillcrest Hospital where she died from her injuries.

19 News is not releasing the child’s name.

Investigators also charged former Cleveland State basketball star Kenneth McFadden, 61, of Euclid.

According to police, Kenneth was seated in the front seat, but initially told officers he was the driver.

Kenneth is charged with obstructing official businesses and wrongful entrustment.

He had a pre-trial in Shaker Heights Municipal Court on July 20. A next court date has not been scheduled.

McFadden was a standout basketball player at Cleveland State University in the 1980’s, leading his team to the Sweet 16 in 1986.

“The Beachwood Police Department extends its deepest condolences to the child’s family and loved ones. We also recognize the impact of this incident on family members, witnesses, first responders, restaurant employees, and others affected by this tragedy,” posted a city official in a news release last month.
